“Vermachen “ und “Vererben” werden oft nicht unterschieden. Das Vermächtnis (Legat) besteht in der Zuwendung eines Vermögensvorteils aus dem Nachlass an den Bedachten. Dabei geht der vermachte Gegenstand nicht von selbst auf den Bedachten über (Vindikationslegat).

Der Bedachte erwirbt vielmehr durch das Vermächtnis nur einen Anspruch auf Verschaffung des Zugewendeten (Damnationslegat) gegen den Erben.

Gegenstand eines Vermächtnisses kann jede rechtserhebliche Handlung sein, die auf Vermögensmehrung des Bedachten gerichtet ist (z.B. Gegenstände, Forderungen, Geld, Wohnrechte). Geschieht dies nicht freiwillig, muss der Anspruch gerichtlich durchgesetzt werden.
