Mit der Einsetzung eines Testamentsvollstreckers kann der Erblasser eine Absicherung seines testamentarischen Willens und vornehmlich bei mehreren Erben und/oder Vermächtnisnehmern eine geregelte Abwicklung des Nachlasses erreichen.
Das Gesetz unterscheidet die Abwicklungsvollstreckung, die letztlich auf die Auseinandersetzung des Nachlasses gerichtet ist, sowie die sog. Verwaltungs- bzw. Dauervollstreckung, bei denen die Verwaltung des Nachlasses im Vordergrund steht.
