Kinder, Ehegatten und eingetragene Lebenspartner des Erblassers sind stets pflichtteilsberechtigt. Entferntere Abkömmlinge (Enkel, Urenkel usw.) und die Eltern des Erblassers sind nur dann pflichtteilsberechtigt, wenn kein Abkömmling, der sie im Fall der gesetzlichen Erbfolge ausschließen würde, den Pflichtteil verlangen kann.

Der Erblasser kann aus bestimmten Gründen dem an sich Pflichtteilsberechtigten den Pflichtteil entziehen. Die Pflichtteilsentziehung muss durch Testament oder Erbvertrag erfolgen. Der Grund der Entziehung muss bei Errichtung bestehen und in der letztwilligen Verfügung angegeben werden. Hier entstehen oftmals gerichtliche Auseinandersetzungen.
